Section 534 of the Municipal Government Act provides that an owner of land that abuts land on which a public work or structure is situated may be entitled to compensation from a municipality for “injurious affection” to the owner’s land. “Injurious affection” means the permanent reduction in the
appraised value of land as a result of the existence, but not the construction, erection or use, of a public work or structure.
Any section 534 claim for compensation must be received by The Town of Canmore within 60 days after publication of this notice. This notice is not an admission of liability by The Town of Canmore. Please note that a claim must be in writing and, at a minimum, state both the amount claimed and the particulars of the claim.
