Fine Print
In this agreement member means “main member”; the main member is referred to as “you” or “the member” and the Town of Canmore/ Elevation Place is referred to as “The Town”, “us”, “we”, or “EP”. This agreement is legally enforceable. By signing this document you are acknowledging that you have read, understood and agreed to the terms herein.
Upon written notice to the member, The Town shall have the right to terminate or modify this membership agreement at any time at the sole discretion of The Town.
Programs and services provided as part of an Elevation Place membership may change from time to time at the sole discretion of The Town without partial and/or full reimbursement of membership fees.
Facility Closure: The Town reserves the right to close specific amenities or the entire facility for repairs, maintenance and special events as it deems necessary/appropriate. The Town will give advance notice of closures due to special events and planned maintenance; however, repairs and maintenance to ensure the safety of staff and/or patrons may be done without notice.
Membership Terms: It is agreed that the term of this agreement is for a period of 1 month or recurring month(s) and the member is liable for all fees as indicated for themselves and family members in accordance with the terms and conditions irrespective of the amount of use the member makes of Elevation Place.
Membership Expiry: ‘Recurring’ memberships shall continue to renew on a monthly basis unless otherwise cancelled in accordance with the terms hereof. Recreation Fee Assistance Memberships will expire after 12 months at which point the member will need to renew with appropriate documentation.
Membership Use: The member agrees to pay The Town the fees specified in the Agreement, irrespective of the amount of use the member makes of Elevation Place.
Membership Hold: Holds are permitted on 'Recurring' memberships under the following conditions:
- A completed Membership Hold Request form must be submitted online, at least one day prior to the requested hold start date.
- Membership holds are only eligible to begin on the first day of the month.
- A membership needs to be active for at least one month prior to applying a hold.
- Membership holds are available in increments of one, two or three months at a time.
- Only two membership holds can be requested per calendar year.
- Membership holds cannot be retroactively applied.
- If you wish to remove your membership hold early, the membership fee for that month will be applied. A hold must be active for 1 month before it can be removed early.
- Memberships that have an account balance owing may not be put on hold until the balance is paid.
- Membership holds are not permitted on 1-month memberships.
- While the membership is on hold, the membership is not considered active and the individual will be considered a non-member for all intents and purposes.
- A hold cannot be applied to any Recreation Fee Assistance (RFA) membership type. RFA members are welcome to cancel their membership and restart when they are ready to return. A current Affordable Services card must be shown to restart an RFA membership. Cancellation requests must follow the direction listed below.
Membership Cancellation: 'Paid in Full' memberships are non-refundable. 'Recurring' memberships may be cancelled under the following conditions:
- A completed Membership Cancellation Request form must be submitted online, at least one day prior to the end of the month.
- Membership cancellations will be effective at the end of the current month for which the notice is provided.
- A membership must be active for at least 6 weeks prior to submitting a cancellation request.
- Cancellations cannot be retroactively applied.
- Membership cancellations are not permitted on 1-month memberships.
Supervision: The member understands that some amenities may be unsupervised during certain hours of operation and that they participate at their own risk. The member further acknowledges that it is their responsibility to obtain training for themselves and Family Members named herein in the proper use of any equipment prior to any use thereof. The Member warrants that they have signed the Town of Canmore / Elevation Place waiver(s) and or acknowledgement of risk on their behalf and each and every Family Member has a waiver/acknowledgement of risk completed.
Suspension or Termination of Membership: The member agrees to abide by the rules, regulations and the Acceptable Use Guidelines of Elevation Place and any amendments which may be enacted hereinafter. Any breach of these rules could constitute reasons for suspension or termination of this agreement and the membership created hereby.
Price Increases: The Town is authorized to change the amount of the monthly payment by giving the Main Member 60 days written notice of the change. Failure on the part of the member to advise in writing on his/her agreement with the change within 30 days of the receipt of this notice by the member shall be deemed to be in full acceptance of such change. Any notice to the member shall be deemed to have been duly given in writing and mailed to the address provided by the member (as outlined in the personal information clause).
Personal Information: The member’s address for service or notice shall be set out on the reverse side of this Agreement or at such other address as the member may from time to time advise The Town of Canmore / Elevation Place in writing. The member is required to provide updated phone number, address, and e-mail contact information to The Town / EP within 10 working days of the change. Members are encouraged to consult with their physician prior to engaging in physical activity.
Privacy: The personal information being collected herein is collected under the authority of the Freedom of Information and Protection of Privacy (FOIP) Act, R.S.A. 2000 Chapter F-25; Section 33(c). The Town of Canmore welcomes and encourages all people to use Elevation Place and the Canmore Recreation Centre and the facilities, programs, and services contained within. In order to protect users’ right of access, ensure the safety of users and staff, and protect resources, facilities and equipment, the Town of Canmore prohibits activities that are illegal, interfere with the use or enjoyment of the facilities by others, present health or security risks, damage resources, or disrupt the normal flow of operations.
Inappropriate Behaviours Prohibited in Town Facilities:
To ensure everyone’s comfort, safety, and access to facilities, resources, equipment, and services, the following are examples of inappropriate behaviour:
- Destroying or damaging facilities or equipment; vandalism of property.
- Harassment and verbal, visual, or physical abuse of other patrons or staff.
- Exhibitionism, sexual advances or abuse, and lewdness.
- Theft.
- Intoxication and/or consuming liquor or using illegal drugs in the premises.
- Repetitive breaking of rules for the use of resources, services, facilities or equipment.
- Eating in sport venues.
- Eccentric behavior.
- Leering/staring/loitering.
- Inappropriate use of technology (cameras, wi-fi, video equipment, music players) in public spaces.
- Fighting.
- Smoking/vaping.
- Any illegal activities.
Patrons agree to abide by the rules, regulations and the Acceptable Use Guidelines of Elevation Place and any amendments which may be enacted hereinafter. Any breach of these rules could constitute reasons for suspension or termination of facility access.
